1. Definitions

Basketball Activities: Any activity, event, program, scrimmage, tour, training, tournament, or competition organised or authorised by Basketball Magic Australia.
Participant: Any individual registered to take part in Basketball Activities and Programs, including minors registered by parents/guardians.
You/Your: The Participant or the Participant’s parent/guardian (where applicable).
Program: Any Basketball Magic Australia authorised event, tour, scrimmage, or training session.
Claim: Any action, demand, loss, damage, liability, cost, or expense arising from or connected with Basketball Activities, except where covered under Basketball Magic Australia’s insurance.

Registration is non-transferable and includes, where applicable, a waiver form.
Participation requires completion of the registration form, payment of applicable fees and acceptance of these Terms and Conditions.
Basketball Magic Australia reserves the right to refuse or cancel registration where necessary (e.g. safety, misconduct, non-payment).

You warrant that you are medically and physically fit to participate.
You must not participate if you have a condition that may affect your safety or the safety of others.
Basketball Magic Australia may request a medical certificate before participation.
You must report any injury, accident, or illness occurring during Basketball Activities.

You agree to follow Basketball Magic Australia rules, event rules and instructions of coaches and supervisors.
Alcohol, drugs, or prohibited substances must not be consumed before or during Basketball Activities.
Misconduct (e.g. fighting, harassment, unsafe play) may result in suspension or removal without refund.

Outdoor activities may be affected by the weather. Basketball Magic Australia may alter, postpone, or cancel activities in the interest of safety.

Basketball Magic Australia maintains insurance; however, coverage may be limited.
Participants are encouraged to obtain personal health, travel and accident insurance, especially for international tours.

Basketball Magic Australia collects and uses personal information in line with the Privacy Act 1988 (Cth) and our Privacy Policy.
Data may be shared with service providers (e.g. insurers, transport, accommodation providers, tour partners such as Impact Basketball in the USA).
Participants may opt out of direct marketing by notifying Basketball Magic Australia.

Basketball Magic Australia is committed to creating a child-safe environment.
All staff and contractors must comply with applicable Working With Children Check (WWCC) requirements.
Participants, parents and staff agree to uphold a safe and respectful environment for children and young people.

To the extent permitted by the Competition and Consumer Act 2010 (Cth) and relevant state Civil Liability Acts, Basketball Magic Australia excludes liability for death, injury, or loss arising from participation in recreational activities, except where caused by reckless conduct or gross negligence.
Jurisdiction-specific warnings (e.g. Victoria, NSW, SA, WA) apply as set out in Schedule 1 of this document.

Participants in overseas or inbound tours acknowledge:

Additional terms may apply (e.g. visas, travel insurance and accommodation policies).
Basketball Magic Australia is not responsible for costs or losses due to cancellations, delays, or changes beyond our control (e.g. airlines, government regulations).

These Terms, together with any Waiver Agreement, form the entire agreement between Basketball Magic Australia and Participants.
If any clause is unenforceable, the remainder still applies.
